Agreement
By downloading, accessing, or using My Mem, you agree to these Terms of Use. If you do not agree, do not use the app or its services. My Mem is operated by Oren Ben-Shaul.
Apple's Standard Licensed Application End User License Agreement governs your license to the iOS app. These terms supplement that agreement and govern My Mem's services. If the two conflict about the app license, Apple's agreement controls.
Who may use My Mem
You must be at least 13 years old and legally able to agree to these terms. If the law where you live requires consent from a parent or guardian, you may use My Mem only with that consent.
Your content
You keep ownership of the notes, links, images, recordings, documents, and other content you save. You are responsible for that content and must have the rights needed to save and process it.
You give My Mem a limited permission to process your content only as needed to provide features you choose, such as local organization, iCloud sync, cloud AI enrichment, export, and support. This permission ends when the content is deleted, subject to limited provider retention, backups, security records, and legal requirements described in the Privacy Policy.
Acceptable use
Do not use My Mem or its cloud services to break the law, violate another person's rights, harm or exploit anyone, or interfere with the service. In particular, you may not:
- submit child sexual abuse material or content that sexualizes, exploits, or endangers a minor;
- submit non-consensual intimate content, sexual violence, pornography, or explicit sexual material for cloud AI processing;
- promote or facilitate self-harm, threats, harassment, hate-based violence, terrorism, weapons, or other violent wrongdoing;
- request instructions that facilitate illegal goods, services, access, or conduct;
- infringe privacy, publicity, intellectual-property, or other rights;
- upload malware, probe the service, disrupt it, automate excessive requests, evade limits, impersonate another user or app, or bypass security or moderation controls; or
- use AI results to make automated high-impact decisions about another person in areas such as employment, housing, credit, insurance, education, legal services, or medical care.
My Mem may reject content, rate-limit requests, temporarily suspend cloud AI for an installation, or permanently restrict access when reasonably necessary to protect users, providers, or the service. To question a restriction, email support@my-mem.app.
AI features
Cloud AI is optional and requires your consent. AI-generated summaries, tags, dates, categories, and other details may be incomplete or wrong. Review important information before relying on it. My Mem is not a substitute for professional medical, legal, financial, or safety advice, and you should not use AI results as the sole basis for decisions with serious consequences.
Cloud AI availability and limits may change to maintain safety, reliability, and reasonable operating costs. A memory may still be saved when cloud AI is unavailable or refuses to process it.
Purchases and subscriptions
If paid features are offered, purchases are processed by Apple and are subject to the price, trial, renewal, cancellation, and refund information shown in the App Store and in My Mem before purchase. Service changes and termination
My Mem may add, change, suspend, or discontinue features. We will try to avoid unnecessary disruption and give reasonable notice of material changes when practical. You may stop using My Mem at any time and can export or delete your data from Settings.
We may suspend or end access to cloud services for a material or repeated violation of these terms, a security threat, legal requirement, or conduct that risks harm to My Mem, its providers, or others. Provisions that by their nature should continue after termination will remain in effect.
Disclaimers and responsibility
To the fullest extent permitted by law, My Mem and its services are provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose. Nothing in these terms excludes warranties or rights that cannot legally be excluded.
To the fullest extent permitted by law, My Mem will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill arising from use of the service. Any liability that cannot be excluded is limited only to the extent the law permits. Apple's Standard EULA provides additional terms concerning warranties and liability for the licensed app.
Governing law
These terms are governed by the laws of California, without regard to conflict-of-law rules, except where the mandatory consumer laws of your home jurisdiction apply. Disputes may be brought in a court with lawful jurisdiction. Nothing here limits a right or remedy you cannot waive under applicable law.
Changes to these terms
These terms may be updated as My Mem changes. The effective date above will be updated, and material changes may also be communicated in the app. Continuing to use the service after updated terms take effect means you accept them, where permitted by law.
